Michael Jordan-owned 23XI Racing remain 'very confident' in NASCAR lawsuit despite recent blow

23XI Racing, the Cup Series team co-owned by Michael Jordan and Denny Hamlin, remain very confident in their lawsuit against NASCAR despite a recent blow in court.

That is according to Hamlin, who addressed a federal appeals court ruling that came last Thursday which means that 23XI, along with Front Row Motorsports, could soon be stripped of their NASCAR charters.

Hamlin has confirmed that 23XI remain committed to running as an open team for the remainder of 2025 if they have to, despite the fact that they face losing tens of millions doing so compared to if they were a chartered team.

The 23XI co-owner also explained that despite the ruling, the team remains upbeat about their chances in the wider lawsuit case.

“We remain very confident in our case for December 1st,” Hamlin explained to the media at Michigan, ahead of his victory on Sunday.

Hamlin: Facts are on 23XI's side in NASCAR lawsuit

Hamlin continued: “We’re confident in it. We feel like the facts are on our side.

“I think if you listen to the judges, even they mentioned that we might be in pretty good shape.”

The above rhetoric was echoed in a statement released by Jeffrey Kessler, the attorney representing 23XI and FRM in the lawsuit.

Speaking after last Thursday's court ruling, Kessler explained: "We are disappointed by today's ruling by the Fourth Circuit Court of Appeals and are reviewing the decision to determine our next steps,"

"This ruling is based on a very narrow consideration of whether a release of claims in the charter agreements is anti-competitive and does not impact our chances of winning at trial scheduled for December 1.

"We remain confident in our case and committed to racing for the entirety of this season as we continue our fight to create a fair and just economic system for stock car racing that is free of anticompetitive, monopolistic conduct."

As mentioned in Kessler's comments, the antitrust lawsuit case is scheduled for December 1, 2025.
