NASCAR have agreed not to move to sell the Cup Series charters of 23XI Racing or Front Row Motorsports for at least another month.

In his decision setting a preliminary injunction hearing for 28th August, Judge Kenneth D. Bell confirmed that the league had agreed not to sell any of the six charters in question at least until that end of August hearing is ruled on.

The statement also confirms that the two teams will be able to race in the Cup Series unhindered by needing to qualify until that date, essentially formalizing the change spotted in NASCAR's rulebook this week.

The minor legal scraps over 23XI and FRM's status for 2025 are very relevant to their overarching lawsuit against NASCAR, which alleges monopolistic behavior, but it has been made clear repeatedly that rulings one was or the other in the many injunction and restraining order requests will have no bearing on the case due to be heard in court on 1st December.

23XI and FRM safe from sale - for now

In his order on Tuesday, Judge Bell wrote: "This scheduling order is entered pursuant to the following conditions: 1) NASCAR represents it will not effectuate any sale or transfer or otherwise convey in any manner the six 2025 Charters offered to the Plaintiffs or purchased until the Court rules on the Motion for Preliminary Injunction.

"2) NASCAR represents that Plaintiffs’ six race cars will qualify for all Cup Series races (if they choose to race) similarly until the Court rules on the Motion.

"In the event NASCAR learns of any reason either of those representations may no longer hold, NASCAR shall promptly inform Plaintiffs and the Court so that the Court can consider implementing any relief it deems necessary."

This means that the two teams will be able to run all six of their collective cars until at least the penultimate race of the Cup Series regular season, although they will make just a third of the prize money now they're officially racing as Open entries for the time being.
