23XI attorney hints at major NASCAR changes if Michael Jordan-owned team win lawsuit

An attorney for 23XI Racing and Front Row Motorsports in their lawsuit against NASCAR has revealed some staggering potential demands if the case goes their way.

The two teams are suing NASCAR in an antitrust lawsuit centered around the sport's charter system, and U.S. District Court Judge Kenneth D. Bell asked attorney Jeffrey Kessler what the teams would want should the December 1st trial go in their favor.

Bell asked that question of Kessler at a hearing this week, with the attorney going on to reel off an extensive possible wishlist, many items on which would change the sport forever.

Among the things the teams may look for if they win their suit are for NASCAR to divest itself of the racetracks it owns, which currently make up just over half the Cup Series calendar, and to remove the prohibition on Cup Series tracks hosting similar stock car events.

23XI and NASCAR warned over huge trial

They will also consider asking for NASCAR to allow teams to use Next Gen cars outside of NASCAR competition, and for any financial damages to be tripled.

The two sides were once again warned that taking the case all the way to trial would likely end poorly for them both, with Bell saying: “Hard to picture a real winner if this goes to the mat, or the flag, in this case."

Kessler insisted later that it is NASCAR, rather than his clients, who are most likely to force the case all the way through the courts, saying: “We’ve always indicated that if there could be a fair settlement breach, that we could come to something that’s good for everybody, I’m a lawyer, I am always open to settlement. I think my clients are always open to settlement.

“(If) they’re not going to agree to anything, we’ll see them at trial. We are very much open to what all the judges are saying … this is a case that should be settled and worked out so that everyone could go forward racing. The fans don’t have to read and hear about all of this, and could have a better system for everyone.”
